Power of Attorney Agent Pitfalls (Webinar)

Among the agent duties set forth in 20 Pa.C.S. Section 5601 are these obligations to:

  • keep a record of all receipts, disbursements, and transactions made on behalf of the principal
  • act so as not to create a conflict of interest that impairs the agent’s ability to act impartially in the principal’s best interest
  • attempt to preserve the principal's estate plan to the extent actually known by the agent, if preserving the plan is consistent with the principal's best interest based on all relevant factors

This one-hour CLE will consider a few significant cases that show how Pennsylvania courts have applied these statutory principles in specific circumstances. The cases illustrate the traps that await unwary agents and provide lessons for agents and their attorneys to consider in their efforts to reduce agent exposure to liability.

Jenkins Law Library, an accredited provider under the Pennsylvania CLE Board's Rules, will serve as the CLE provider for this course. The course has been approved by the Pennsylvania Continuing Legal Education Board for 1.0 hour of CLE credit in ethics.

This program has been approved by the Board on Continuing Legal Education of the Supreme Court of New Jersey for 1.0 hour of total CLE credit in ethics/professionalism.
