A Primer on the Foreign Intelligence Surveillance Act and Section 702 (Webinar)

Electronic surveillance is one of the most important foreign intelligence collection tools available to the U.S. government. Because the ability to surveil constitutes one of those activities most susceptible to abuse by a government against its citizens, the government’s use of electronic surveillance in the United States is highly regulated and can be conducted for only two purposes: law enforcement, which is undertaken by both federal and state governments; and foreign intelligence collection, which is an exclusively federal government function conducted pursuant to a single authority - the Foreign Intelligence Surveillance Act (FISA).

This course explains how FISA operates with a particular emphasis on FISA Section 702: the most controversial component of FISA that was narrowly reauthorized by Congress in April 2024 and will be up for renewal again in 2026. Collectively, the surveillance authorities provided in FISA impact virtually every major intelligence collection effort used to acquire foreign intelligence in the United States and arguably represent the most important intelligence collection tool available to the U.S. government.

Provider:
Jenkins Law Library, an accredited provider under the Pennsylvania CLE Board's Rules, will serve as the CLE provider for this course. The course has been approved by the Pennsylvania Continuing Legal Education Board for 1.0 hour of CLE credit in substantive law, practice and procedure.

This program has been approved by the Board on Continuing Legal Education of the Supreme Court of New Jersey for 1.0 hour of total CLE credit.
