The Pennsylvania Superior Court's 2024 decision in Commonwealth v. Fitzpatrick (2024 PA Super 101), allowing expert medical testimony to support the prosecution's case, appears to conflict with another 2024 Superior Court decision, Commonwealth v. Delvalle (2469 EDA 2022), in which an expert witness was prohibited from testifying to bolster the credibility of the defendant.
This one-hour CLE will consider both cases in light of the issue of the admissibility of expert opinion evidence on so-called ultimate issues for decision by the ultimate fact finder.
Provider:
Jenkins Law Library, an accredited provider under the Pennsylvania CLE Board's Rules, will serve as the CLE provider for this course. The course has been approved by the Pennsylvania Continuing Legal Education Board for 1.0 hour of CLE credit in substantive law, practice and procedure.
This program has been approved by the Board on Continuing Legal Education of the Supreme Court of New Jersey for 1.0 hour of total CLE credit.
